1. The Defendants’ respective Plaintiff:

Reasons
1. Facts [based on recognition] Gap evidence Nos. 1 through 3, Eul evidence Nos. 2, each appraisal commission of appraiser A, and Eul, the purport of the entire pleadings was to complete the registration of ownership transfer by winning a successful bid of each real estate listed in the attached Table Nos. 2, “Real Estate List” (hereinafter collectively “instant real estate”) on May 25, 2012, and on March 14, 2014, the real estate listed in paragraphs 3 and 4 of the above real estate list among the instant real estate was sold at the military time and completed the registration of ownership transfer by reason thereof.
From May 25, 2015, the Defendants occupied and used the land and buildings in attached Form 3 (a) through (f) of the instant real estate from among the real estate to the present date.
Of the instant real estate, the rent for each land and building in attached Forms 3 (a) through (f) shall be KRW 37,91, 237, and KRW 30,453,358 from May 25, 2012 to May 24, 2013; and KRW 30,453,358 from May 25, 2013 to March 13, 2014; and KRW 1,370,344, and from May 25, 2014 to May 24, 2014, the rent for each real estate indicated in attached Form 1 “the indication of real estate” shall be KRW 1,370,344, and KRW 1,216,420 from May 25, 2014.
2. 판 단 청구원인에 관한 판단 : ▷위와 같이 인정된 사실관계에 의하면, 피고들은 원고에게 별지1 ‘부동산의 표시’ 기재 각 부동산을 인도할 의무가 있고, 차임 상당의 부당이득금을 지급할 의무가 있다.
▷부동산의 점유사용으로 인한 이득액은 그 부동산의 임료 상당액으로 봄이 옳으므로, 피고들이 원고에게 지급하여야 할 부당이득금의 액수는 68,444,595원(= 37,991,237원 30,453,358원)과 원고가 구하는 2014. 3. 28.부터의 지연손해금, 2014. 3. 14.부터 2014. 5. 24.까지 월 1,370,344원의 비율에 의한 돈, 2014. 5. 25.부터 별지1 ‘부동산의 표시’ 기재 각 부동산 인도완료일까지 월 1,216,420원의 비율에 의한 돈이다.
