Punishment of the crime

On May 29, 2014, around 00:15, the Defendant was killed in the top of the victim C(56 years old)'s convenience store near the second apartment that was located in the Geum-si-si, Jeonju-si, who was going to the Defendant's house and was going to the Defendant's house at the Yangju-si, the Defendant did not pay the taxi fee. 이후 피고인은 피해자로부터 택시요금의 지급을 요청받자, 자신의 가방을 뒤지면서 ‘핸드폰과 지갑이 없어졌다’고 소리치며 문을 열고 하차하여서는 조수석 의자를 뒤로 밀고 지갑을 찾는 시늉을 하고, 피해자가 운전석에서 내려 조수석 쪽으로 와 글로브박스(일명 ‘다시방’)에서 꺼낸 손전등으로 불을 비추며 고개를 숙여 의자 밑을 수색하는 것을 보고서는 한손에 돌멩이를 쥐고 피해자에게 다가가 피해자의 머리를 수회 내리치고 피해자에게 ‘너는 내가 여기서 죽일 수 있다. 여기서는 소리를 질러봐야 누가 오는 사람도 없다. 나는 여기 잘 안다. 너는 여기서 날 쫓아오지 못한다’고 위협하며 계속하여 주먹과 발로 피해자의 몸통을 수회 때려 피해자를 인근 공동묘지 언덕으로 데리고 갔다.

그리고 피고인은 계속하여 한손에 쥔 돌멩이로 피해자의 머리, 몸통을 수회 때리는 등으로 반항을 억압하여 피해자가 가지고 있던 담배를 빼앗고, 택시요금 38,160원 상당의 지급을 면하였으며 피해자에게 약 15일간의 치료가 필요한 ‘두피의 열린 상처’ 등을 가하였다.
