1. The plaintiff's claim is dismissed.

1. Details of the disposition;

A. On March 1, 1990, the Plaintiff was newly appointed as an annex kindergarten teacher at B elementary schools, and from March 1, 2013, the Plaintiff served as an annex kindergarten at C elementary schools.

B. Around June 4, 2013, the Plaintiff: (a) caused “cerebral cerebral chrophism after blood transfusion; (b)” from June 14, 2013 to September 5, 2013, the Plaintiff used 59 days and annual leave of absence for two years from September 6, 2013 to September 5, 2015; and (c) returned to the Plaintiff on September 21, 2015.

C. On December 30, 2015, the General Disciplinary Committee on Public Educational Officials in Chungcheongnam-do decided to the Plaintiff by ex officio dismissal on the following grounds. On January 5, 2016, the Defendant rendered an ex officio dismissal disposition against the Plaintiff on the basis of Article 70(1)4 of the State Public Officials Act (when the period of temporary retirement expires or the grounds for temporary retirement cease to exist, or the Defendant is unable to return to duties or perform duties after it ceases to exist).
