1. The plaintiff's claim is dismissed.

1. Basic facts

A. C owned a building of 240 square meters and E large 228 square meters (hereinafter “each of the instant lands”) and each of the instant lands (hereinafter “instant building”). However, the National Agricultural Cooperative Federation, the mortgagee of each of the instant lands, filed an application for an auction to exercise the security right to each of the instant lands with the Gwangju District Court Maritime District Court, and the auction procedure was commenced on December 19, 2003.

In addition, G purchased each of the instant lands at the above auction procedure on October 14, 2004 and completed the registration of ownership transfer on January 26, 2005.

G filed a lawsuit against Gwangju District Court Decision 2012Gadan6025, Gwangju District Court Decision 2012Gadan6025, which sought the return of unjust enrichment equivalent to the rent for each of the instant lands, along with the removal of the instant buildings and the delivery of each of the instant lands. In the process of the said lawsuit, the “Adjustment on February 7, 2013” refers to the following adjustment:

(1) On July 31, 201, G sells each of the lands of this case to a person designated by C or C, KRW 5,000,00. 2. G pays KRW 55,00,00 to G by July 31, 2013, and at the same time pays it by C or to a person designated by C or C, G shall carry out the procedure for registration of ownership transfer of each of the lands of this case. 3. If C does not pay KRW 55,00,000 by July 31, 2013, it shall be automatically cancelled the sales contract of paragraph 1. In this case, G shall be returned if it has received money from C, and C shall remove the building of this case and deliver each of the lands of this case to G on May 1, 205, and completed the registration of ownership transfer in the procedure for compulsory auction of this case.
