Punishment of the crime

1. The defendant is a person who actually operates the J (hereinafter "J") which is delegated with the overall implementation of the construction project of the apartment of this case including the purchase of land for the construction of the IF apartment of this case on the 243 parcel of land from the IF association (hereinafter "victim association") and the IE apartment of this case (hereinafter "the apartment of this case"). Although there was a duty to properly use the property of the victim association for the purpose of the construction project of this case and manage it as an agent in the construction of the apartment of this case, the defendant did not borrow money as security 304 out of J's name for the construction of the apartment of this case, even though he did not have borrowed money from 300,000,000 won for the above apartment of this case, 00,000 won for personal use after obtaining the cancellation of the registration of the establishment of the mortgage from L which manages the property of the victim association, 00,000 won for the above apartment of this case, 70,000,000 won for the above loan of this case.
