1. The plaintiffs' primary and conjunctive claims against the defendants are all dismissed.
2. The costs of lawsuit are assessed against the plaintiffs.
Reasons
1. Basic facts
A. The plaintiff A is a party. The plaintiff A is a G main apartment complex G on the ground other than Yongsan-gu Seoul Metropolitan Government F (hereinafter "the apartment complex of this case").
(2) The seller of the instant apartment is the seller of the instant apartment at 101 Dong 1204, and the Plaintiff B is the buyer of the instant apartment at 102 Dong 2401 and 103 Dong 3504, and the Plaintiff C and D are the buyer of the instant apartment at 103 Dong 1201, and the seller of the instant apartment at 103 Dong 1201. 2) The Defendant Asian Trust Co., Ltd. (hereinafter “Defendant Asian Trust”) is the seller of the instant apartment, and the East Asia Construction Industry Co., Ltd. (hereinafter “Dong Asian Construction Industry”) is the contractor of the instant apartment at the time of the construction of the instant apartment, and the Defendant L& E&S Co., Ltd. (hereinafter “Defendant L&S”) is the truster of the instant apartment at the time of the construction of the instant apartment between the Defendant Asian Trust and the Defendant Asian Trust by concluding a management-type land trust contract as of December 18, 2009.
B. 1) H, I, J, K, Plaintiff C, and D entered into a sales contract with Defendant Asian Trust to purchase each of the relevant apartment units stated in the column of the sale price on the corresponding date indicated in the table column as follows. 2) L comprehensively takes over the status of the buyer under the sales contract as to the instant apartment unit 101 Dong 1204 from H on April 4, 2012, and Plaintiff A comprehensively takes over the status of the buyer under the sales contract as to the instant apartment unit 101 Dong 1204 from L on May 17, 2012.
3) On May 24, 2012, Plaintiff B comprehensively succeeded to the status of the buyer under the sales contract for the instant apartment No. 102 Dong 2401 from I and J on May 24, 2012, and on June 14, 2012, Plaintiff B comprehensively comprehensively succeeded to the status of the buyer under the sales contract for the instant apartment No. 103 Dong 3504 on June 14, 2012 (hereinafter collectively referred to as “each of the instant sales contract”).
4) The Plaintiffs each of the instant sales contracts to Defendant Asian Trust on each of the following corresponding dates.
