1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Details of the disposition;
A. On October 15, 198, the Plaintiff was appointed as a police officer on March 1, 2012, and promoted to the police officer on March 1, 2012, and served in the House B of the Government Police Station from February 18, 2013 to July 16, 2014, and thereafter served in the House B of the Government Police Station in the House B of the Government Police Station.
B. On July 31, 2014, the General Disciplinary Committee on Police Officers in the Speaker’s Police Station decided to the Plaintiff for one month of suspension from office on the grounds that the following disciplinary grounds arise. On August 4, 2014, the Defendant issued a disposition of suspension from office for one month to the Plaintiff pursuant to Article 78(1)1 through 3 of the State Public Officials Act on the grounds that the Plaintiff’s above act was in violation of Articles 56 (Duty of Good Faith), 57 (Duty of Custody) and 63 (Duty of Maintenance of Dignity) of the State Public Officials Act.
[징계사유] 2014. 5. 14. 02:00 ~ 04:00 상황근무시 관리반 자리에 앉아 인터넷을 하여 출동대기 근무자 2명이 상황근무 자리에서 상황근무를 하고 있자 순찰3팀장 경감 D이 시정할 것을 요구하자 “아, 씨발 더러워서 근무 못하겠네, 내가 어디 멀리 있는 것도 아니고, 피의자가 있는 것도 아니고 너무 하지 않느냐, 왜 3팀장만 자원근무자를 힘들게 하느냐, 경감 달고 뭘 그렇게 유세를 떠느냐, 자꾸 원칙을 따지는데 야간자원 근무를 계속 나와 지켜보겠다”라고 하는 등 약 30분 동안 상급자에게 대들고, 2014. 5. 초경 야간자원 근무시 순찰차 근무가 1번에서 2번으로 변경되자, 위 경감 D에게 “직원들의 여론은 수렴했습니까, 다른 지구대와 형평성 문제도 있고 잘못됐다”라며 항의하는 등 위계질서를 문란케 하고(이하 ‘제1 징계사유’라 한다), 2014. 5. 11. 06:00경부터 도보근무임에도 2층 숙직실에서 자다가 위 경감 D의 지시를 받은 직원이 깨우자 약 15분 늦게 도보근무를 나가고, 2014. 6. 2. 야간자원근무 후 총기를...
