Reasons
Punishment of the crime
N (the indictment of detention on May 16, 2013) is the representative of P Co., Ltd. established for the purpose of wholesale and retail business of grain processed food on the fourth floor of the 4th floor of the Busan BO building. Defendant A is the head of the management team of the said Co., Ltd., Defendant B, Defendant C, Defendant D, and Defendant E who recruited members at the head office of the said Co., Ltd., Defendant F is the Seoul Center head of the said Co., Ltd., Defendant F is the Seoul Center head of the said Co., Ltd., Defendant G, Defendant H is the Seoul Center head of the said Co., Ltd., Defendant H, Defendant H is the Seoul Center head of the Seoul Center, Defendant H is the head of the Gocheon Center, Defendant J is the head of the Ulsan Center, the head of

No person who violates the Food Sanitation Act shall indicate or advertise that the food, etc. is likely to have efficacy or effect in preventing and treating diseases with respect to the names, manufacturing methods, quality and nutrition labelling, genetically modified foods, etc., and food traceability labeling, or to mislead or confuse them as medicine or health functional foods;
Nevertheless, from August 5, 201 to April 10, 2013, the remaining Defendants except the above N and Defendant A established 10 P Co., Ltd. P Co., Ltd. headquarters on the fourth floor of the O building in Busan Island from around August 5, 2011 to around April 10, 201, and established 10 P Co., Ltd.; and, in selling “R” supplied by Q from Q, “R” had an advertisement to the effect that “the effect of treating the P Co., Ltd., such as rain, circulation disorder, high blood pressure improvement, humping effect, anti-bropic effect, anti-bropic effect, grheatization, grheatization, grheatization, grheatization, anti-copic effect, anti-grheatization, prevention of brheatation, prevention of brheatation, and improvement of notified blood transfusion,” Defendant A, as the management team at the above headquarters.
As a result, the Defendants conspired with the above N to indicate or advertise that they may have efficacy or effect in preventing and treating diseases, or to mislead or confuse them as medicine.
