A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.

Punishment of the crime

During the trial of embezzlement against the Defendant in Busan District Court 2014No2859 on November 28, 2013, the Defendant: (a) received 100,000 won check from C, which was found at the Defendant’s home on November 28, 2013 and kept 10,000 won check, and deposited it into the Defendant’s post office account; (b) withdrawn KRW 3 million around December 18, 2013 and used it for personal purposes; and (c) even though around December 2013, C did not return KRW 3 million to C before the Defendant’s house was located, C had been willing to compel C to give false testimony.
