피고인은 2012. 11. 1. 19:00경 순천시 C병원" 입원실에서 여러 환자들과 같이 텔레비젼을 시청하면서 갑자기 춤을 추고 노래를 부르며 시끄럽게 하여 피해자 D(50세)이 이를 제지하며 손목을 비틀며 207호 병실로 데리고 들어가자 이에 화가 나, 양손으로 피해자의 목을 조르고, 손톱으로 가슴을 후벼 파고, 오른손 손목을 꺽어서 바닥에 넘어뜨려 피해자에게 약 2주간의 치료를 요하는 우측수부 타박상등의 상해를 가하였다.
