A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant is an employer who ordinarily employs 10 workers on a steel structure manufacturing and installing business with the trade name of Ulsan-gun B.

"2012 Highest 3535"

1. On July 1, 2011, the Defendant entered the same workplace and works as an official title.

On August 1, 2011, an employee C’s retired on July 1, 201, and a total of KRW 12,536,680,00 in arrears with three employees, as shown in the attached Table of Crimes List (1), did not pay each of them within 14 days from the date of retirement, which is the date of the occurrence of the cause for the payment, without agreement between the parties to the extension of the due date.

2. The Defendant did not pay KRW 225,00 for wages in December 2012, 201, which had been employed in the above workplace on September 1, 201, on February 25, 2012, which had not been paid in February 2012, which was the regular payment date of wages, as indicated in the attached Table of Crimes (2) and did not pay KRW 26,175,410 on the 15th day of each month, which is the regular payment date of wages.

The defendant of "2012 Highest 3537" works in the above enterprise from September 3, 201 to April 28, 2012.

A total of KRW 2,685,00 of wages E of retired workers was not paid within 14 days from the date of retirement, and the total of KRW 50,662,586 of the wages of 7 workers was not paid within 14 days from the date of each retirement, as shown in the attached list of crimes (3).

The defendant of "2012 Highest 3843" works from the above enterprise to January 31, 201, as an official service from December 20, 201 to January 31, 2012.

Without agreement on the extension of the due date for payment between the parties, the amount of KRW 2,780,000 of the wage balance of the retired worker F was not paid within 14 days from the date of retirement, which is the date of the occurrence of the cause for payment, and the amount was not paid within 14 days from the date of retirement, as described in the attached list of crimes (4), without agreement on the extension of the due date between the parties concerned.
