1. The plaintiff's claim is dismissed.

1. Basic facts

A. On December 30, 2008, the Plaintiff entered into an insurance contract with the Defendant, the insured, and the beneficiary other than death as the Defendant (hereinafter “instant insurance contract”). The instant insurance contract includes the collateral payment for the daily amount of hospitalization when the insured is hospitalized due to illness or injury.

B. From March 2, 2010 to March 17, 2010, the Defendant received hospital treatment for 12 days in total for 106 days as shown in attached Table 2 from around the time to May 10, 2016, from the time when the Defendant received hospital treatment from B to “self-pathocinary crym cancer” as “self-patary catary catal catum cancer” at the oriental medical hospital B from March 2, 2010, as well as from around that time to May 10, 2016.

Details of the guaranteed insurance contract of which coverage is similar to those of the insurance contract of this case among the insurance contracts in which the defendant is the insured are listed in attached Table 3.

Before the conclusion of the instant insurance contract, cancer insurance contracts, pension insurance contracts, etc. are excluded, where the content and nature of the instant insurance contract cannot be similar.

The amount paid by the Plaintiff to the Defendant is KRW 20,655,277, and the insurance company mentioned in attached Form 3, including the Plaintiff, determined as insurance amount paid to the Defendant due to the instant insurance accident, etc. is KRW 57,587,297.

E. In 2011, the Defendant purchased the land and its ground land of Gwangju Nam-gu, Gwangju, and paid the property tax on the said real estate while holding it. While working as an insurance solicitor, the Defendant reported income to the tax authority as follows.
