Reasons
Punishment of the crime
1. Defendant A’s crime is a person who is working as a representative director of D Co., Ltd. from around 2008. In order for a person who has retired from employment insurance to receive unemployment benefits from the Ministry of Employment and Labor, the number of days worked for the 18-month period prior to the date of departure from employment should be at least 180 days, and the number of days worked for the 1-month period prior to the date of applying for recognition
Nevertheless, the Defendant was employed by 16 persons, including N,O, P, Q, R, S, and T, who did not meet the requirement for receiving unemployment benefits because they did not meet the requirement for receiving unemployment benefits for at least 180 days since he/she was employed in a relationship or received introduction with the aforementioned F, such as E, F, G, H, I, J, K, K, L, and M, which he/she was known to the general public, and had the D corporation accounting personnel B enter the false work details of E, such as E, into the website from January 2010 to September 2010.
In addition, around October 21, 2010, E applied for the recognition of unemployment benefits based on the above false labor details at the office of the Busan District Employment and Labor Office in Ulsan-gu, Busan-gu, Busan-do, and its affiliated status was recognized as the recipient of unemployment benefits from November 4, 201 to January 25, 201, and received 2,690,200 won in total as unemployment benefits on four occasions from November 4, 201 to January 25, 201.
The Defendant, in addition to this, from November 3, 2010 to November 28, 2011, had a daily employed worker B report the working days of daily employed workers on 16 occasions as shown in the attached Table 1 of Crimes List from around November 3, 201 to November 28, 201, and had the daily employed worker B transfer 28,51,420 won of unemployment benefits.
Accordingly, the defendant, in collusion with E, received unemployment benefits by fraud or other improper means, and at the same time acquired money from the victim from the Republic of Korea.
