1. The plaintiffs' appeals against the defendants are all dismissed.
2. The costs of appeal are assessed against the Plaintiffs.
Reasons
1. The reasoning for this part of the judgment of the court is as stated in Paragraph 1 of the reasoning of the judgment of the court of first instance, in addition to the fact that the court dismisses “ May 29, 2015” as “ May 27, 2015,” “No. 5,” and the ground for this part is as stated in the main sentence of Article 420 of the Civil Procedure Act, since the reasoning for the judgment of the court of first instance is the same as that for the judgment of the court of first instance, in addition to the fact that “(including each number; hereinafter the same shall apply)” as “(s) No. 3, 2015, May 27, 2015.”
2. Determination as to the cause of claim
A. Defendant D did not notify that the instant land will be divided into the franchise at the time of each purchase and sale of the instant land. Unlike the promise, Jeju-si, which explained that the instant land will be used as a road adjacent to the instant land, sold to a third party a forest of H 61 square meters (hereinafter “the instant adjacent land”), which constitutes a tort by deception.
The Defendant Company is liable for compensating the Plaintiffs for damages incurred by Defendant D in connection with his duties in accordance with Article 35(1) of the Civil Act, and Defendant E actively participated or aided in the tort committed by Defendant D. As such, the Defendants, as joint illegal actors, should jointly compensate for the damages incurred by the Plaintiffs’ property and mental distress.
B. The facts without dispute over judgment, Gap evidence Nos. 2, Eul evidence Nos. 2 and 3, and the video of evidence Nos. 2 and 3, the defendant company presented provisional partition (Evidence No. 2) to the plaintiffs before entering into each of the instant sales contracts and let the plaintiffs know the location, shape, etc. of the instant land after dividing the instant land. Each of the instant sales contracts states that "each party (the plaintiffs) confirms all the terms and conditions of the instant real estate before purchasing the said real estate and concludes a contract at his own will." The plaintiffs filed a complaint against defendant D with the intention of fraud, but the prosecutor of the Jeju District Public Prosecutor's Office "at the time the plaintiffs visited the site together with defendant D" at the time of the plaintiffs visiting the site.
