Reasons
1. The reasoning for this part of the basic facts by the court is as follows: (a) 14 pages 2 of the judgment of the court of first instance (hereinafter “Plaintiff bus”) with respect to “non-city bus” (hereinafter “Plaintiff bus”) 14 pages 2 of the judgment of the court of first instance; (b) 3 pages 10 “as indicated in the separate sheet,” and 4 “as indicated in the separate sheet, until December 4, 2017” (including each number), and 12 pages 4 “(including each number),” except for the addition of “the separate number,” the reasons for the judgment of the court of first instance are as stated in the main sentence of Article 420 of the Civil Procedure Act. Thus, this is cited as it is in accordance with the main sentence of Article 420 of the Civil Procedure Act.
2. The parties' assertion
A. The Plaintiff’s assertion that the instant accident occurred, in addition to the Plaintiff’s violation of the duty to stop on the front line of the Plaintiff bus or the duty to secure the safe distance of Defendant bus, as prescribed by Article 38(1) of the Road Traffic Act, due to the competition of the Defendant bus’s violation of the duty not to turn on the left-hand direction following the change of the bus line, the Defendant’s negligence shall exceed 30%.
B. The Defendant’s assertion that the instant accident occurred solely by the negligence of the Plaintiff bus, and the negligence of the Defendant bus cannot be recognized. Even if the Defendant bus violated the Road Traffic Act relating to the change of the bus line or violated the duty to ensure safety distance, the causal relationship with the instant accident cannot be recognized.
3. Determination
A. The driver of any motor vehicle in the relevant legal doctrine and the rate of negligence 1) If the driver of any other motor vehicle follows another motor vehicle traveling in the same direction, he/she shall maintain a necessary distance to avoid any collisions with the motor vehicle traveling ahead of it, if the latter stops suddenly (Article 19(1) of the Road Traffic Act). In addition, the driver of any motor vehicle shall not change course when it is likely to impede normal traffic of another motor vehicle traveling in the direction to which he/she intends to change course of the latter (Article 19(3) of the Road Traffic Act).
