1. All of the plaintiff's claims are dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Facts of recognition;
A. The defendant is a non-corporate body composed of the representatives of occupants of Gwangju Northern-gu B apartment.
B. On March 18, 2015, the Plaintiff entered into a labor contract with the Defendant for the period of work from March 18, 2015 to March 17, 2016, the monthly wage of KRW 1,800,000 (basic wage of KRW 1,50,000, KRW 300,000, and KRW 300,000) and the monthly wage payment date of KRW 25,00, and thereafter, had worked as the head of the management office of the apartment from that date.
Article 50 (Retirement) (1) Where an employee falls under any of the following subparagraphs, he/she shall retire:
1. Two to five. (Omission) (2) In cases where an employee under Article 51 desires to retire, he/she shall submit his/her retirement report by not later than seven days prior to the date of retirement;
Article 54 (Restrictions on Dismissal, etc.) (1) No appointment authority shall dismiss, suspend, transfer an employee, reduce his/her wages, or take other disciplinary measures without justifiable grounds.
(2) When an appointment authority dismisses, etc. under paragraph (1), it shall notify in advance and give an opportunity to vindicate.
Article 5 (Dismissal) (1) A management office may dismiss any person falling under any of the following subparagraphs:
8. A person who has inflicted damage on the management entity by divulging any confidential information in the course of business; 14. A person who has directly damaged the reputation or credit of the apartment and the management entity.
Article 56 (Exclusion from Application of Pre-Announcement of Dismissal) (1) The provisions of the preceding Article shall not apply to the person falling under any of the following subparagraphs:
4. A disciplinary action under Article 58 (Categories and Classification of Disciplinary Action) shall be taken against, ipso facto retirement or resignation according to the following classifications:
5. Dismissal: It refers to the dismissal of a person who has no opening, due to extremely serious circumstances, who is deprived of his/her status, and shall be resolved by clarifying whether to give notice of immediate dismissal or not;
