As to the crimes No. 1 in the judgment of the defendant, fines of KRW 3,000,00 shall be imposed on the crimes No. 2 in the judgment.
Reasons
Punishment of the crime
The Defendant was sentenced to two years of imprisonment for fraud at the Daegu District Court on January 20, 2017, and the judgment became final and conclusive on February 1, 2017.
[Criminal facts]
1. The Defendant attempted to dispose of the height of the scrap metal owned by the Defendant in a different place, but it is not easy for the Defendant to dispose of it in a different place, and when the victim purchases it as owned by another person, he would be able to dispose of the said scrap metal in a way that the Defendant disposes of it again in another place and left profits.
Accordingly, on May 29, 2013, the Defendant: (a) placed the victim C at the top of the Defendant’s operation in the Gandong-gun, Gandong-gun, D around 2013, the Defendant agreed to sell to E; (b) KRW 600,000,000 for the repair cost from E to Na at KRW 7 million; and (c) 14,000,000,000 for the introduction cost of selling to others.

However, the above scrap metal was owned by the defendant and could not be repaired to the extent of disposing of it in another place, and it was not disposed of in another place until now. Therefore, the defendant did not have the intent or ability to make profits from disposing of the above scrap metal in another place for the victim.
Nevertheless, on May 29, 2013, the Defendant: (a) by deceiving the victim as above; (b) received KRW 7 million from the victim as the purchase-price from the victim; and (c) received KRW 7,00,000 from the Agricultural Bank Account (F) in the above E’s name; and (b) received KRW 600,000 from the Defendant’s wife’s corporate bank account (H) on June 7, 2013, and acquired KRW 7,60
