A defendant shall be punished by imprisonment for two years.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

At around 13:55 on May 14, 2014, the Defendant sent a text message to the victim C, known at Ploex pipe C, to the effect that “C may purchase approximately KRW 112 tons of a new pipe product at a low price of KRW 418,000,000,000.” On May 15, 2014, the Defendant received from the victim C and D an appropriate amount of KRW 1.5 billion for each of the 1.5 billion, “C and 1.5 billion for each of the 1,50,000,000,000,000 won for each of the 1,50,000,000 won for each of the 1,50,000,000 won for each of the 1,50,000,000,000 won for each of the 1,50,000,000,000 won for each of the 1,545,05,00,00.

However, the fact was that the defendant was requested by the J of the director of the I Co., Ltd., the owner of director pipeline 112 tons and did not enter into a contract for the above goods, and there was no fund to pay KRW 29 million which is 50% of the purchase price for the goods. Even if he received the money from the victims as the purchase price for the goods, he did not use it as the price for the vehicle purchase, living cost, and the acquisition price for other factories.

As such, the Defendant, by deceiving the victims, acquired a total of KRW 29 billion from the victims.
