A defendant shall be punished by imprisonment for four months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On August 2012, 2012, the Defendant: (a) was employed as a delivery source on the same day; (b) was engaged in the delivery and collection affairs of the said restaurant; and (c) received 125,000 won from customers and kept them in custody on behalf of the victim on his/her duty on August 2012, 200, when he/she received 125,000 won from customers.

At around 16:00 on the same day, the Defendant made a statement that he would get a bank to get a female to the victim under the above E, and held the above KRW 125,00 as it is, and embezzled by voluntarily consuming it as living expenses, etc. in the vicinity of the Si, Suwon-si.

2. On February 17, 2014, around 09:00 on February 17, 2014, the Defendant: (a) was employed as a delivery source on the same day; (b) was engaged in the delivery and collection of the said restaurant; and (c) received KRW 190,000 from customers, and had them keep in custody for the victim.

At around 13:00 on the same day, the Defendant: (a) told the victim to accept delivery to the victim at the H restaurant; (b) held the above KRW 190,00,000 on the part of the market price of the Plaintiff, and then embezzled the above KRW 1,790,000 in total by voluntarily consuming the capital of KRW 190,00,000 on the part of the Si.

3. On March 6, 2014, around 09:00 on March 6, 2014, the Defendant was employed as a delivery source on the same day and was engaged in the delivery and collection of the said restaurant, and received KRW 93,000 from customers, and had the Defendant keep the said restaurant in custody on behalf of the victim.

At around 13:00 on the same day, the defendant said that he would remove the misunderstanding to the victim in the above restaurant, and then the market price that the victim delivered and kept for business.
