1. As to the Plaintiff KRW 34,00,704 and its KRW 200,000,100 among them, the Defendant shall pay to the Plaintiff KRW 334,00,000 from May 29, 2015, and KRW 134,00,604.
Reasons
1. Facts of recognition;
A. On April 30, 2014, the Defendant, a trust real estate owned by the Defendant, was combined with 60 square meters in Seongdong-gu Seoul, Seoul, the land for gas stations B, 314 square meters in the land for gas stations C, 73 square meters in the land for gas stations, 470 square meters in the land for gas stations, and 314 square meters in the land for gas stations B, C gas stations, 73 square meters in the land for gas stations, and 470 square meters in the land for the above A gas stations, and 917 square meters in the land for gas stations.

2) The tender on the tender (hereinafter referred to as “instant tender”)
(1) The public auction notification of this case shall be given from May 7, 2014 to May 12, 2014 (hereinafter “instant public auction notification”).
The notice was posted on the electronic asset disposal system (www.on.co.k.) managed and operated by the Defendant. The contents related to this case in the instant notice of public auction are as listed below. 6. Transfer of ownership 1) The Defendant bears only the responsibility for the transfer of ownership on the registry following the sale of the real estate list, and all restrictions on the public auction goods as of the bidding date in relation to this real estate.
5) The buyer accepts the present condition of the auction property, and the organization of the existing stakeholders are responsible for the buyer.7.1) The buyer grasps in advance the present status of the auction property and the matters of regulation of the public law and so on.
2) The buyer is not responsible for cancellation of all legal, factual, and legal relationship of the subject matter of the public auction, including taxes, public charges and management fees, delivery and order, limitation (such as collateral mortgage, provisional attachment, provisional disposition, superficies, lien, etc.). 3) The seller bears the remainder of the due date of payment among taxes and public charges (the pertinent taxes, various charges, and all other taxes and public charges) arising on the subject matter of the public auction, and the part arising after the due date of remainder payment.
