1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

Details of the disposition

The Plaintiff established and operated a “C” private teaching institute in Gangnam-gu Seoul on April 15, 2009, and a “E” private teaching institute in Gangnam-gu Seoul on November 21, 201, Gangnam-gu, Seoul on November 21, 201.

(C) Around July 2013, the Plaintiff registered the tuition fees of each of the instant private teaching institutes with approximately KRW 300 per minute, and the Defendant notified that the tuition fees exceed KRW 238 per minute, which is the adjusted standard amount set by the Defendant.

On September 2013, the Plaintiff applied for the individual adjustment of tuition fees for the nine lectures of each of the instant private teaching institutes to the Defendant.

After completing the review by an accounting firm and the deliberation by the Mediation Committee for Tuition Fees (hereinafter referred to as the “Mediation Committee”), the Defendant: (a) determined the tuition fees for 7 courses among 9 courses for which the Plaintiff applied for each of the instant private teaching institutes on the ground that “the number of students per course of each of the instant private teaching institutes falls short of the Defendant’s guidelines for individual adjustment of tuition fees and it is difficult to accept the Plaintiff’s application as they were; and (b) determined the tuition fees for the two courses at a higher level than the standard amount of adjustment; and (c) issued an order for the adjustment of tuition fees on November 29, 2013 after having notified the Plaintiff on November 12, 2013.
