가. 피고인은 2017. 1. 17. 경 불상의 장소에서 피고인이 관리하는 카카오 뮤직 ‘C’ 뮤직 룸 게시판에 피해자 D( 남, 48세 )에 대한 협박 피의 사건이 벌금 50만 원의 구 약식 처분이 되었다는 부산지방 검찰청 검사 명의의 통지서 사진을 게시한 다음 피해자의 닉네임인 ‘E ’에 대해서 “E 똘 아이 같은 새끼 등 신지 을해 라~~~~ 니가 무슨 교주가 저리 본 안 부치면 차단 한다 했다면서~~~ 넌 사람 아냐~~ 사기꾼 아 딸도 가짜고 지가 모 잘난 줄 아나~~~~~ 꼴 갑을 떨어라

야!! 니가 가만 안 낫 두면 우짤 건데 미친 새끼“ 라는 글을 게시하여 공공연하게 피해 자가 형사 사건으로 기소된 사실을 드러내러 피해자의 명예를 훼손하였다.

B.
