Punishment of the crime
[criminal power] On January 23, 2014, the Defendant was sentenced to ten months of imprisonment for fraud, etc. at the Ulsan District Court, which became final and conclusive on May 23, 2014, and completed the execution of the sentence in the Incheon Prison on September 30, 2014.
【Criminal Facts】
1. The Defendant, through fraud and fraudulent means, committed an act of obstruction of performance of official duties with respect to the acquisition of lost articles, such as cash and precious metals, which many unspecified persons lost, by registering such lost articles in “LOST112”, which is a website for the management of lost articles on the National Police Agency’s website, and making it easy for the police officers who keep lost articles to know the date, place, condition of lost articles, etc.
On November 10, 2014, the Defendant acquired information that “the cash amount of KRW 30,00,00 which is lost to the above district is kept in custody,” through the search of the above website “LOST112” at the Eunpyeong-gu Seoul District Police Station D District, Eunpyeong-gu Seoul, Seoul, and the Defendant stated that “The Defendant lost 30,000 won in cash to the victim E, who is a person in charge of the above district relics, although he did not lose 30,000 won in cash, the Defendant received 30,000 won in cash from the victim, who was in charge of the above district relics at the time before the JOST12, and received 30,000 won in cash from September 14, 2013 to November 13, 2014, the Defendant received 27,690,000 won in cash from the police officer’s legitimate management by means of a deceptive scheme, as shown in the attached Table I (I).
2. Where a large number of unspecified persons using subways or trains acquire lost articles, such as cash and precious metals, from which they have lost, in a service room, the accused shall interfere with fraud and business, such lost articles are Seoul Matro, Urban Railroad Corporation and Urban Railroad Corporation.
