A defendant shall be punished by imprisonment for a term of one year and eight months.

Reasons
Punishment of the crime
The members of the Bophishing fraud team, who misrepresented an unspecified number of people by phone calls, would increase the credit rating when the existing loans are redeemed before maturity. The amount of the existing loans was remitted, and when personal information was leaked while misrepresenting to investigation agencies, they make false statements, such as sending the amount of the existing loans in cash, and delivering it to employees of the Financial Services Commission. The cash collection books conspired with the employees of the Bophishing fraud team in order to take part in the collection of Bophishing cash, such as sending the amount of the existing loans at low interest. In addition, the victims were sent to the cash collection books, falsely assuming the employees of financial institutions and the employees of the Financial Services Commission, and receiving 30,000 won as allowances.
On November 28, 2019, an employee of the Singishing fraud team called the victim B by phone to the victim B, and falsely called the “a loan to be made up to a maximum of 6% interest rate of 28 million won if an existing loan is repaid even during the period of the loan.” The Defendant, while working as an employee of a financial institution, instructed the victim to transfer the account without passbook to the account notified after receiving cash from the victim.
Accordingly, the Defendant, as indicated in the attached crime list, by deceiving each victims from the above date to December 6, 2019, by deceiving them from the above date and time to December 6, 2019, received KRW 40,30,000 from the victims, and attempted to obtain by fraud, and arrested the police officers and attempted to commit attempted crimes.
