Reasons

1. Basic facts

A. On October 30, 2017, the Plaintiff entered into a sales contract with Defendant D, a licensed real estate agent, for the purpose of running his/her business, to purchase land E (hereinafter “instant land”) from Defendant B and C in the Nam-gu, Seo-gu, Sinpo-si (Fet, land substitution area of KRW 106.9 square meters, approximately 306.9 square meters; hereinafter “instant land”) from Defendant B and C for the purpose of running his/her business, and paid KRW 650 million to the Defendants a down payment of KRW 590 million on the date of the contract (hereinafter “instant sales contract”), and on the same day, the Plaintiff paid the down payment of KRW 60 million to the Defendants.

가. 선택적 청구원인 ① ⑴ 피고 B, C : 부당이득반환청구 ㈎ 기망에 의한 매매계약의 취소 이 사건 매매계약은 매수일로부터 상당한 시일 내에 이 사건 토지에 관하여 관련 인ㆍ허가를 받을 수 없다는 것을 고지할 의무가 있음에도 이를 고지하지 않는 위 피고들의 기망행위로 체결된 것으로서 취소되어야 하므로, 위 피고들은 원고에게 계약금 상당액을 부당이득으로 반환할 의무가 있다.
