1. Of the distribution schedule prepared on September 22, 2014 by the above court with respect to voluntary auction cases A with respect to the Gu Government District Court A real estate.
Reasons
1. Basic facts
A. Hengum Co., Ltd. (former trade name: Postal metal Co., Ltd.; hereinafter “BO”) received loans from Nong Bank Co., Ltd. (hereinafter “CF”) on three occasions as listed in Table 1 below.
(1) A loan of No. 1 (hereinafter referred to as "No. 1"), No. 2 (hereinafter referred to as "No. 2 loan"), and No. 3). - A loan of No. 1 510,000,000 of a temporary loan of April 16, 2009, on April 16, 2016, 2009, general loan of No. 150,000,000 on June 3, 2012, 2009.
On June 11, 2009, U.S. entered into a credit guarantee agreement between the Plaintiff and the Plaintiff on June 11, 201, with the guarantee term of KRW 365,000,000, and the guarantee term of June 11, 2014 (hereinafter “the credit guarantee agreement of this case”).
C. On June 11, 2014, the Plaintiff: (a) had to acquire a fixed date collateral in spite of whether the Plaintiff provided an appraisal of the construction of the following facilities (hereinafter “facilities specifications”); (b) had to set up a second-class mortgage above the amount guaranteed under the Factory Mortgage Act immediately after the completion of the factory building in the building site located in the Guamanam-si Local Industrial Complex Ebro-2; (c) had to acquire a third-class mortgage above the amount guaranteed under the Factory Mortgage Act; (d) the right to claim the return of the purchase price arising from the termination of the sale contract of the building site in the workplace; and (e) the right to claim the return of the sale price arising from the termination of the sale contract of the building site in the workplace; and (e) the right to collateral security acquired under the terms and conditions of this guarantee shall be used as a collateral only for the guaranteed loan; (e) the details of the facilities shall be 10k-type (90gg/Gs/Gs; (e) the manufacturing process of the facilities in the previous building site.
