Reasons
Punishment of the crime
1. On August 1, 2015, the defrauded: (a) around 04:00 on August 1, 2015, the Defendant went to the “E” entertainment tavern operated by the victim D in Suwon-si C.
In fact, even if the defendant did not have an intention or ability to pay the price due to the absence of money in a state without a certain occupation and residence, the defendant ordered the worker F of the above entertainment drinking house as if he would pay the price.
Accordingly, the Defendant, by deceiving the above F, did not pay the price for the two weeks equivalent to the market price of 200,000,000 won from the above F, thereby acquiring property benefits from the above victim.
2. On August 2, 2015, the defrauded: (a) around 03:00 on August 2, 2015, the Defendant went to the “I” PC operated by the Victim H in Young-gu G in Suwon-si, Suwon-si.
In fact, at the time, the Defendant used the said PC computer for about 33 hours from August 3, 2015 until August 30, 2015, even though the Defendant did not have any money in a state of absence of a certain occupation and residence and did not have any intent or ability to pay the fee, as if he would pay the fee to the said PC employeesJ.
Accordingly, the Defendant, by deceiving the above J, did not pay 310,000 won when using the said PC computer, thereby obtaining pecuniary benefits equivalent to the above amount of money from the said victim.
3. On August 3, 2015, on August 3, 2015, the fraud Defendant entered the 'M operated by the victim L in the six-story K in Suwon-gu, Suwon-si, Suwon-si on August 3, 2015.
At the time, the defendant ordered that he would pay the price to N of the above main employee even though he did not have any intention or ability to pay the price because he did not have any money in a state without a certain occupation and residence.
As a result, the defendant deceiving the above N and was provided with 7,90,000 won in total with the market price from the above N, but did not pay the price.
