A defendant shall be punished by imprisonment with prison labor for not more than ten months.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. The Defendant is a person engaged in the duty of driving Category B rocketing vehicles in violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Bodily Injury resulting from Risk Driving)

On February 9, 2017, the Defendant driven the said vehicle while under the influence of alcohol level of 0.182% from blood alcohol level around 23:50 on February 9, 2017, and driven the front road located in Gwangju Northern-gu C in the direction of the cancer market, one lane between the two lanes in the direction of the border and the long distance.

At the time, it was difficult to view the vehicle at night, and in this case, the victim's vehicle was stopped on the front side of the driver's vehicle, so in such a case, the driver's vehicle has a duty of care to prevent the accident by accurately manipulating the steering gear and brake system of the vehicle in advance by taking into account the front and rear left and right of the vehicle.

Nevertheless, due to the negligence of the Defendant’s negligence while under the influence of alcohol, the Defendant got off the part of the Defendant’s vehicle behind the Defendant’s vehicle driving F Alti-math in front of the Defendant’s passenger vehicle ( South, 60 years old) driving in front of the traffic signal.

Ultimately, the Defendant driven a car in a state where normal driving is difficult due to the influence of drinking, and suffered injury to the said victim G (V, 59 years old) who was accompanied by the said victim and the said damaged vehicle, for about two weeks of medical treatment.

2. On March 13, 2009, the Defendant was sentenced to a summary order of KRW 2 million for a crime of violating the Road Traffic Act at the Gwangju District Court on March 13, 2009, and a fine of KRW 6 million for a crime of violating the Road Traffic Act (driving alcohol) at the same court on June 14, 2012.

On February 9, 2017, at around 23:50, the Defendant driven Bunching vehicle under the influence of alcohol level of about 0.182% from the section of approximately 1km to the front road located in Gwangju Northern-gu, Gwangju Northern-gu.
