1. All appeals filed by the Defendant (Counterclaim Plaintiff) are dismissed.
2. The costs of appeal shall be assessed against the principal lawsuit and counterclaim.
Reasons
1. Basic facts
A. From June 28, 2007, the Plaintiff entered into a consignment management contract (hereinafter “instant management contract”) with the prosperity Association of the instant building with respect to the Dtel located in Incheon Gyeyang-gu, an aggregate building (hereinafter “instant building”), and renewed the contract with the prosperity Association of the instant building, and is a controlled entity that is performing the management of the instant building until now. The Defendant is a sectional owner who owns the instant subparagraph F, and was in charge of the prosperity president or the management body representative of the instant building.
B. The main contents of the instant management contract are as follows.
The term of contract: the part subject to management from June 28, 2007 to June 28, 2012, and the part subject to management from June 28, 2012 and the details of the entrusted affairs of the management office are as follows:
1. Maintenance and repair of facilities, such as facilities for common use of an aggregate building and facilities for joint ownership, welfare facilities, etc. (excluding inside a shop possessed by a person holding a right to subdivision and exclusive use and security affairs);
2. Class B (Plaintiffs and hereinafter the same shall apply) contracts for the management of facilities, expenses, cleaning, garbage removal (repair of ELV, electric safety management, fire prevention management, disinfection, disinfection, water tank cleaning, sanitary management services, etc., among the management of a building;
(1)A contract shall be entered into under its supervision and upon the selection of the service provider Party A (the instant case, hereinafter the same shall apply).

3. Imposition, collection and receipt of management expenses, and vicarious payment of public imposts;

7. The business of cleaning building outer walls, painting, substantial repair, and extension and remodeling of buildings may be ordered to contract to B according to the Gap's plan;
Article 7 (Management Expenses)
1. The management expenses shall be collected equally in accordance with the number of months per month, and the owner and the occupant of the building shall pay the management expenses collected every month;
The notice of management expenses shall be distributed to the relevant number of units of the management building five days before the payment deadline is completed.
(1) Wages for general management personnel, costs for appointing fire prevention managers, electricity safety management agency, and others.
