A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

피고인은 2013. 8. 23. 90일 관광 비자로 중국 연길에서 대한민국으로 입국한 중국인으로, 2103. 9. 13.경 연길 고향 친구인 ‘E’으로부터 인터넷 메신저인 ‘위챗’을 통해 ‘통장과 현금카드 등을 보내줄 테니 이를 받아서 현금을 인출한 후 중국으로 송금해달라’는 취지의 부탁을 받고 이를 승낙하였다.

On September 17, 2013, from around 14:02 to around 14:43, 2013, the Defendant used a computer, etc., the Defendant misrepresented an investigator of the prosecutor’s office by telephone to the victim D, and falsely speaks as necessary for the resolution of the case related to the theft of name of the said victim. Accordingly, the Defendant intended to enter the said financial information from the said victim to the new bank account (H) in the said victim’s name without permission and transfer KRW 4,889,869 in total from the said victim’s new bank account (J) to the one in the said victim’s name.
