The prosecution of this case is dismissed.

1. On September 30, 2013, the Defendant assaulted the victim C (19 years of age) who was seated on the rear seat of the bus due to the fact that the victim C (19 years of age) aboard the bus stops (16-829) in the domestic bus stops (16-829) in the city of the Kimpo Airport located in Gangseo-gu Seoul Airport from the Kimpo-si, Gangseo-gu, Seoul. On September 30, 2013, when the victim was seated on the rear seat of the bus due to his/her hand floor and drinking, the Defendant assaulted the victim at a time on several occasions.

2. The facts charged in this part of the judgment are crimes falling under Article 260(1) of the Criminal Act and cannot be prosecuted against the victim’s explicit intent pursuant to Article 260(3) of the Criminal Act. Since the victim prepared and submitted a written withdrawal of the complaint to the effect that the victim does not wish to punish the defendant on or around January 22, 2014, the prosecution of this case is dismissed pursuant to Article 327 subparag. 6 of the Criminal Procedure Act.
