Basic Facts
D Status of the parties is the owner of the building listed in the attached Table 1 (hereinafter referred to as the “multi-family house in this case”), and the lessor who concluded a lease contract with the Plaintiff, and the Defendant’s assistant intervenor (hereinafter referred to as the “participating”) is the real estate real estate agent who arranged the above lease contract and the Defendant is the real estate mutual aid association to which
On March 28, 2015, the Plaintiff entered into a lease agreement with D on March 28, 2015, between D and D regarding the instant multi-family house E (hereinafter “instant leased house”) (hereinafter “instant lease agreement”) and the lease agreement between D and D with respect to the lease deposit amounting to KRW 80,00,000, and the lease period from March 29, 2015 to March 29, 2017 (hereinafter “instant lease agreement”).
On March 30, 2015, the Plaintiff paid all the lease deposit to D. On April 3, 2015, the Plaintiff moved in on April 3, 2015 and completed a move-in report and received a fixed date in the lease contract.
On the other hand, before the Plaintiff entered into the instant lease agreement, each of the maximum debt amount in the name of the F Association (hereinafter “F Association”) and KRW 72,00,000,000 was completed in the instant multi-family house.
On July 20, 2016, at the request of the FF Association, the auction procedure for the instant multi-family house (hereinafter referred to as the “instant auction procedure”) was initiated in the Changwon District Court Tong Branch G in the Changwon District Court.
In the instant auction procedure, the appraisal price of the instant multi-family house and its site was KRW 798,961,240, but the instant multi-family house and its site were sold in KRW 627,77,00.
In the instant auction procedure, the Plaintiff filed a report on rights and demanded a distribution, but on October 25, 2017, the above proceeds of sale were distributed as shown in the table below, and the Plaintiff did not receive any dividend.
