Defendant shall be punished by a fine of KRW 8,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

1. On October 7, 2018, the Defendant refused to take a alcohol test as described in paragraph (2) as he/she was discovered in the crackdown on drinking driving before the gas station located in Young-gu, Young-gu, Young-si, G, and assaulted three-time the shoulder e-throbbs of the Young-gu Department D, which attempted to take a alcohol test against other controllers.

Accordingly, the defendant interfered with the legitimate performance of official duties of police officers on the duty of regulating drinking driving.

2. 도로교통법위반(음주측정거부) 피고인은 제1항 기재 일시, 장소에서 F BMW 승용차를 운전하던 중 위 경장 E 등으로부터 피고인에게서 술 냄새가 나고 발음이 부정확하며 보행상태가 비틀거리는 등 술에 취한 상태에서 운전하였다고 인정할 만한 상당한 이유가 있어 23:00경, 23:11경 2회에 걸쳐 음주측정기에 입김을 불어넣는 방법으로 음주측정에 응할 것을 요구받았으나 계속 입김을 불어 넣는 시늉만 하는 방법으로 이를 회피하다가, 23:14경 피고인이 스스로 혈액채취를 요구하여 23:46경 용인시 수지구 G에 있는 ‘H’ 병원에서 채혈 요구를 받았으나 다시 채혈을 거부하겠다고 수회 말하면서 「채혈동의 및 확인서」에 자필로 ‘채혈거부’라고 기재하고 서명 날인하였다.

Accordingly, the defendant did not comply with a police officer's request for a alcohol test for about 45 minutes without justifiable grounds.
