1. Facts of recognition;

A. The Plaintiff is in the heart of capitalizing the first and the mountain ginseng in the area of Gangwon-do.

B. Around September 5, 2012, the Plaintiff entered into a sales contract with the Defendant for the sale of KRW 20 million for KRW 80,000,000 for KRW 20,000 (hereinafter “instant sales contract”). Around that time, the Plaintiff handed over KRW 1 Ppuri (hereinafter “the instant mountain ginseng”) to the Defendant.

C. The defendant delivered the mountain ginseng of this case to the party who would purchase it, and the defendant's branch stated that the above mountain ginseng was within 20 years from experts and returned the above mountain ginseng to the defendant.

Therefore, the defendant tried to resist the training of the mountain ginseng of this case by walking the phone to the plaintiff, and to request the appraisal of the mountain ginseng of this case. 마. 피고는 원고가 강원도 양구의 대암산에서 직접 캤다는 이 사건 산삼이 15년 내지 17년된 야생산삼이라는 감정결과가 나오자, 2012. 9. 27.경 감정을 하기 위하여 원고로부터 같은 곳에서 캤다는 약 40~50년 된 국내산 야생 산삼인 천종삼 40뿌리를 대금 4,000만 원에 매수하고 대신 이 사건 매매계약상 매매대금 2,000만 원은 지급하지 않는 것으로 하여 원고로부터 위 산삼을 인도받아 한국산삼산양산삼감정협회에 이에 대한 감정을 의뢰하였다.
