1. The part of the judgment of the court of first instance against the plaintiff corresponding to the amount ordered to be paid below shall be revoked.

B. The main contents of the terms of the instant insurance contract are as follows.

Article 4 (Compensation for Loss) (1) When the insured has been diagnosed and confirmed as cancer (except for cases where the insured has received diagnosis or treatment due to the disease during the past five years from the date of subscription for an insurance contract), or when the insured has been diagnosed and confirmed as a result of the insured (except for cases where the insured has received diagnosis or treatment due to the disease within the past five years from the date of subscription for an insurance contract) during the insurance period (Provided, That this shall not apply to cases where the insured has received diagnosis or treatment due to the disease within the past five years from the date of subscription for an insurance contract), only the amount determined under the following subparagraphs for the first diagnosis shall be paid to the beneficiary (if the beneficiary is not designated as the beneficiary, the insured).
