1. The instant lawsuit shall be dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

Details of the disposition

From November 3, 2009, the Plaintiff lost the Plaintiff’s dependent eligibility as December 1, 2012, on the ground that the Defendant, who was provided by the National Tax Service with the income data belonging to the year 2011 from the Plaintiff’s 2011, was recognized as business income belonging to the year 2011, on the grounds that “the Plaintiff is registered as business operator, and is recognized as business income belonging to the 3,5310,000 won.”

(2) The Defendant: (a) recognized the Plaintiff as an individually insured person; (b) imposed and collected the insurance premium pursuant to Article 69(5) of the National Health Insurance Act; (c) Articles 8(2) and 9(1) of the Act on Long-Term Care Insurance for the Aged; and (d) Article 4 of the Enforcement Decree of the Act on Long-Term Care Insurance for the Aged, the Plaintiff received the notice of the instant insurance premium around the said time.

The Defendant imposed and collected the instant insurance premium, and notified the Plaintiff of the following amount after the lapse of the payment deadline: (a) the Defendant imposed the overdue charge without paying it by the specified payment period specified in the notice:
