D Co., Ltd. is a building contractor, who is a contractor in charge of new apartment construction works in Daegu Suwon-gu E, and the defendant C is the site manager of the above D Co., Ltd.

A Co., Ltd. is a business owner who subcontracted the above construction work from D Co., Ltd., and Defendant A is a site manager of the above Co., Ltd.

1. On October 11, 2017, Defendant A had the victim F perform the work of dismantling pit pumps from the first floor of the roof tower from the above E apartment 105-dong around October 10, 2017.

As such, in order to prevent danger to workers, a business owner shall conduct a preliminary investigation into the topography and ground conditions of the relevant workplace and record and preserve the results thereof, taking into account the results of the preliminary investigation, shall prepare a work plan for safety measures that may occur in handling heavy objects, and shall inform the workers of the plan and have them conduct work in accordance with the work plan, and shall designate a conductor to direct the work in accordance with the work plan, and have him/her conduct a dismantling work after hanging the pit pumps and not dismantle the fixed hardware before every month.

Nevertheless, the Defendant did not conduct a preliminary investigation on the place of the work in question, and did not prepare a work plan containing safety measures against the crash, and did not have the work conductor take measures to command work in accordance with the work plan. By demolishing the mine pumps to the cke, the Victim F, who was under work inside the pit pumps, fell on the ground below about 45 meters of the pit pumps together with the pit pumps.
