1. Fraud;

A. On October 15, 2014, at around 23:00, the Defendant: (a) committed as if he would pay the alcohol value to the victim E, an employee; and (b) ordered the victim to pay liquor equivalent to KRW 224,000 at the market price.

However, the defendant did not have any intention or ability to pay the price even if he orders alcoholic beverages, etc.

The Defendant, by deceiving the victim as such, received property, such as alcoholic beverages worth 224,00 won at the market price, from the victim, thereby deceiving the victim.

B. On February 9, 2015, around 22:30 on February 22:30, 2015, the Defendant issued an order for both liquor sets, etc., to the G Age Club in the Daegu Suwon-gu F, as if he would pay the drinking value to the victim H who is an employee.

However, the defendant did not have any intention or ability to pay the price even if he orders alcoholic beverages, etc.

The Defendant, by deceiving the victim as such, received property, such as alcoholic beverages worth 250,000 won at the market price from the victim, thereby deceiving the victim.

2. From January 20, 2015 to January 21, 2015, the Defendant was in charge of delivery and receipt of money while working as delivery employee at the Daegu Northern-gu Kcafeteria located in J-gu operated by the victim I as the delivery employee.

On January 21, 2015, the Defendant arbitrarily consumed KRW 240,000, including KRW 50,000 and KRW 190,000 received from the victim while working as delivery employee at the above restaurant on January 21, 2015, for personal purposes, such as personal debt repayment, etc. of the Defendant.

Accordingly, the Defendant embezzled 240,000 won, which was kept on duty for the victim.

[2015 Godan1188] On January 24, 2015, the Defendant, while working as an employee from the “N” operated by the victim M in Daegu-gu L Commercial Building underground 101 around 21:5, 2015, using the gaps in which the victim’s surveillance was neglected.
