In light of the records, the court below is just in maintaining the judgment of the court of first instance that acquitted the defendant on the facts charged of this case on the grounds that there is no proof of the facts charged, and there is no error of law such as misunderstanding of facts beyond the bounds of the principle of free evaluation of evidence against logical and empirical rules, or misunderstanding of the legal principles as to the attribution of ownership of goods or the intention of unlawful acquisition in larceny

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
