A defendant shall be punished by imprisonment for six months.
However, the execution of the above sentence shall be suspended for a period of one year from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. On June 7, 2017, from around 23:30 to around 01:00 the following day, the Defendant obstructed the victim’s restaurant business by force for about one hour to 30 minutes by avoiding disturbance, such as drinking alcohol in the “E” restaurant operated by the victim D, Bupyeong-gu, Incheon, without any justifiable reason, and continuing to boom the victim, while drinking alcohol in the “E” restaurant.
2. On June 8, 2017, the Defendant: (a) as the Defendant: (b) around 01:00 on June 8, 2017, the Defendant: (c) avoided disturbance; (d) coming out of the above restaurant; and (d) unloaded the victim F’s truck driver’s seat, which was parked there, by drinking around KRW 300,00 of the repair cost.
3. As indicated in paragraph 1, the Defendant: (a) arrested a flagrant offender to the police officer and security guards of the Incheon Bupyeong Police Station G police box, who reported the disturbance to 112 as the date he was sent; and (b) sent to the G police box located in the Incheon Bupyeong-gu J, Incheon.
