A defendant shall be punished by imprisonment with prison labor for not more than ten months.
However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime
【2017 Highest 2481” [Presumption Facts] The Defendant was a person working at a construction site and takes part in daily workers. Before receiving construction expenses, the Defendant paid daily allowances from the victim New World Manpower Co., Ltd. in advance to workers who borrowed money from the victim’s new World Manpower Co., Ltd. before receiving the payment of construction expenses, he/she has been in the way of paying the victim with fees.
[2] On July 30, 2016, the Defendant made a false statement to the victim company employees at the victim new World Manpower Corporation Office, Guro-gu Seoul Metropolitan Government, Guro-gu, Seoul, that “The Defendant paid money for the daily wage of workers because 10 workers were worked at the construction site B with 10 workers and at the construction site C with interest.”
However, in fact, the Defendant prepared a false work certificate as if the employees did not work at the above construction site, and submitted it to the victim company and made a request for payment of daily allowances.
The Defendant received KRW 810,00,000 from the injured party under the name of the daily cash borrowed from the same day to the company bank account (D) under the name of the Defendant, etc. until September 13, 2016, as shown in the list of crimes in the attached Table, from September 13, 2016.
Accordingly, the defendant was given property by deceiving the victim.
On November 28, 2017, the Defendant driven a e-mail-man car under the influence of alcohol content of about 0.080% from the 2km section of approximately 2km to the road front of the Cheongsung Industrial Complex, which is in the two sides of Pyeongtaek-si, Pyeong-si, Pari, Pari, Pari-ri, Pari-ri, Pari-ri, Pari-ri, Pari-ri, Pari-ri, 561.
