1. The Defendant’s KRW 60,000,000 for the Plaintiff and the following: 5% per annum from January 16, 2013 to June 6, 2015.
Reasons
1. Indication of claim;
A. By September 2012, the Plaintiff lent KRW 70 million to the Defendant several times, and the Defendant agreed on September 25, 2012 to pay the Plaintiff KRW 70 million by November 30, 2012.
B. On January 15, 2013, the Defendant repaid KRW 10 million to the Plaintiff, but did not repay the remainder of the loan.
C. Therefore, the Defendant is obligated to pay to the Plaintiff 60 million won with 5% per annum as stipulated in the Civil Act from January 16, 2013 to the delivery date of a copy of the application for the instant payment order, and 20% per annum as stipulated in the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings from the following day to the date of full payment.
2. Judgment by service (Article 208 (3) 3 of the Civil Procedure Act).
