A. On December 9, 2013, the Plaintiff entered into a contract with the Defendant for a contract for civil engineering works (hereinafter “instant contract”) of KRW 306,00,000 (excluding value-added tax) (hereinafter “instant contract”) among the construction works that newly build a crop cultivation house in the KRW 40,00,00,000 with the Defendant’s land. The main contents are as follows.

Standard contract for private construction works

1. The name of the construction work: Civil engineering work among the new construction work for a certified crop cultivation shed in a net thousand City;

2. Construction place: D in a net thousand City/Do;

3. Date of commencement: December 10, 2013.

4. Scheduled date of completion: March 2014.

5. Contract amount: Total amount (unit: 306,00,000 won by general list (excluding value-added tax);

(a) Earth and sand - Acquisition of road sites, cutting of trees, transport, filling-up, etc. 211,152,500

(b) Legal side protection hole - decision making later, such as Law side protection hole - Law side seed spraying, front rocks stockpiling, etc.

(c) Packaging - concrete packaging 1,087,580

(d) Drainage hole - 69,031,000, such as installation of thorium stations, installation of thorium pipes, installation of PE pipes, installation of marries, collection and alteration, and dysium;

(e) Military unit construction - 306,271,00,000 net construction cost of 23,00,000 on-site facilities construction cost of 304,271,080 indirect labor cost of 1,00,000,000 environmental conservation and management cost of 1,00,000,000 - Profits and expenses - 306,271,080 fractional rearrangement (271,080), estimated amount of 306,00,000 estimates (excluding value-added tax)

B. The instant construction site is largely divided into A, B, and C. The A site is a relatively perfect slope, and the B site is located in a steep slope.

C. Since then, on March 7, 2015, the Plaintiff settled the construction cost of the part of the Defendant and earth as KRW 310,000,000, and concluded that the construction cost of the part of the lower court’s construction cost will be actually settled after completion of the construction cost of the legal surface protection hole, the lower court’s retaining wall, the packing hole, the drainage hole, and the incidental hole (hereinafter “other construction cost”).
