The prosecutor's appeal is dismissed.

1. The summary of the grounds for appeal is that the Defendant, as the proprietor of the instant lodging establishment, bears the duty of care to preserve and manage the lodging establishment in order to prevent accidents from being caused by the deterioration of the said establishment. The fact that the funeral glass attached to the wall of the guest room may fall away from the wall due to the passage of time is sufficiently anticipated even based on the general common person engaged in the lodging business.

Therefore, although it can be deemed that the accident of this case occurred due to the defendant's breach of duty of care, the court below acquitted the facts charged of this case, and there is an error of law affecting the judgment.

2. Determination

A. The summary of the facts charged in the instant case is that the Defendant is a proprietor of B hotel business in Pakistan.

The Defendant, as a person operating a hotel business, has a duty to manage well the facilities of the hotel room and to keep the hotel guests free of all, and in particular, B hotel attached the funeral glass to the wall of the glue gly contact with the kitchen, and thus, in order to prevent the glue glass from falling on the wall of the glue room, the Defendant neglected to perform his duty of care to check the fixed capacity before installing an additional fixed device or falling prevention glus team, or receiving an accommodation, and caused the victim D (21 years old) of the above B hotel C on August 18, 2018, and caused the victim to suffer from injury to the right side of the victim, such as the victim’s glue gy that was attached to the wall of the glue gly glue gly gly gly gly gly humbly humbly humbly humd.

B. The lower court rendered a judgment that acquitted of the facts charged in the instant case on the grounds stated in its reasoning.

C. The Defendant’s judgment of the political party is the guest room at the lower court.
