The plaintiff's claim is dismissed.

Litigation costs shall be borne by the plaintiff.

1. Since 1997, the Plaintiff’s summary of the Plaintiff’s assertion has supplied the Defendant’s petition factory with a printing balance plate (which is used to print pictures and letters on the surface of the ospill box).

The Defendant unfairly lowered the subcontract price for a printed balance plate supplied by the Plaintiff from November 2015 to December 2016 by taking advantage of its superior position. Accordingly, the Plaintiff suffered damages from KRW 9,061,93 in total from around the above time to December 2016.

Article 4 (Prohibition of Determination of Unreasonable Subcontract Consideration) (1) Where a principal contractor entrusts a subcontractor with the manufacture, etc., he/she shall not compel a subcontractor to determine or accept subcontract consideration at a level lower than the price generally paid for the same or similar manufacture, etc. of subject matter, etc.

(2) Any act by a principal contractor falling under any of the following subparagraphs shall be deemed fixing unreasonable consideration for subcontract:

1. Fixing subcontract consideration by putting the unit price at a uniform rate without any justifiable reasons;

5. It constitutes an act that a principal contractor unilaterally determines the subcontract consideration at a low price, and thus, constitutes an act that violates the subcontract consideration, thus seeking compensation for such damages.
