1. The plaintiffs' primary claims are dismissed.
2. The defendant is against the plaintiffs:
(a) undermining the declaration of intention to employ;
(b).
Reasons
Basic Facts
Around May 2010, the New World Co., Ltd. (formerly changed on March 2001: New World Department Store; hereinafter referred to as the “NE”) established Empt Co., Ltd. (hereinafter referred to as the “Empt”) by dividing the Empt business division in charge of Empt business.
At the time, the non-party company was operating the Embrate as a contracting shop, and succeeded to the Embrate as it was.
On February 29, 2012, after the Defendant was incorporated into the New World Group on December 2, 2011, the Defendant received 19 business takeovers, which had been operated as a contracting shop from Emart, and operated 19 business units by combining these 19 business units and 120 business stores.
Plaintiff
A, around June 1, 198, and around February 4, 2002, Plaintiff B entered the company of the non-party, respectively, and worked in the Emart business division. As above, the Emart business division applied for a voluntary retirement of approximately KRW 53 million, and Plaintiff C received approximately KRW 53 million as the incentive for job change, and Plaintiff C received KRW 3 million as the incentive for job change.
8. 31. The retirement was respectively withdrawn.
At the time of introduction of personnel in charge of Emart business, the Plaintiffs were employed as the posts of Empt S. S. S. in order of the Plaintiff (the same applies even after the Defendant took over the business as above). During such working period, Plaintiff A and B were employed as the posts of Emb Co., Ltd. from September 201 to February 201, 201, respectively, and from April 201 to March 201, 201, Plaintiff C were employed as Emb Co., Ltd., Emb’s Emb’s Emb’s Emb’s Emb’s Emb’s Emb’s Emb’s Emb’s Emb’s Emb’s Emb’s Emb’s Emb’s Emb’s Emb’s Emb’s Emb’s Emb’s Emb’s Emb’s Emb’s Emb.
The supply and demand company to which the plaintiffs, including Albnb, belong, is a company established by all the officers of the Ebnb business division or Eb.
