1. Facts of recognition;

A. On October 8, 2013, the Defendant: (a) A multi-family house B (hereinafter “instant house”) in the Namyang-si Seoul Construction Co., Ltd. on October 8, 2013.

) A new construction project was contracted with the following content. However, if value-added tax is included in the contract amount, the total construction cost is KRW 666,362,484 (the contract amount is KRW 650 million) (the value-added tax is KRW 16,362,484). The o contract amount is: 650 million (the contract amount is 10% at the time of the contract), 10% at the time of the completion of the structural frame of the second floor, 20% at the time of the completion of the structural foundation of the second floor, 10% at the time of the non-construction, 10% at the time of the completion of the preparation of the completion document, 40% at the time of the lease of the new building: 1/100 (per day) at the time of the completion of the new construction project, Seoul Construction Corporation was changed to the 27th of the construction project without mutual consent of the defendant on December 6, 2013 (the 27th of the new construction project).

3) On May 14, 2014, the Intervenor constructed most of the instant new housing construction works and delivered the instant housing to the Defendant. On May 14, 2014, the Defendant obtained approval for the use of the instant housing, and completed registration of the preservation of ownership in the name of the Defendant on May 19, 2014. (B) On July 18, 2014, the Intervenor transferred KRW 660,08,000,000 to the Defendant on KRW 8 sites, including the instant new housing construction cost claim (hereinafter “Dasan”), and on July 23, 2014, the Intervenor notified the Defendant of the transfer of the instant housing assignment.
