Defendants shall be punished by a fine of KRW 7,000,000.

The Defendants did not pay each of the above fines.

Punishment of the crime

1. Defendant A (2017 High Court Decision 2246), Defendant A, from July 2013 to July 31, 2014, is an intention to operate a member of the D Council located in Jung-gu Seoul Metropolitan Government C.

No person shall induce any act of introducing, arranging, or inducing patients to medical institutions or medical persons for profit, such as exempting or discounting the principal's apportionment under the National Health Insurance Act or the Medical Care Benefits Act, providing money, goods, etc., or providing transportation convenience to many and unspecified persons, etc.

Nevertheless, on July 2013, Defendant A agreed to pay 15% of the sales proceeds of the above procedure products via the Internet website called “F” operated by E, which is a mail order distributor, in return for inducing and arranging patients to purchase the coophones provided by the above member.

E, accordingly, from July 2013 to July 31, 2014, performed 1:1 counseling among patients who intend to receive various types of D Council members on the said “F site, and had the patients purchase coophones provided by the said hospital to induce and arrange patients to D Council members. In return, the Defendant paid KRW 72,895,950,00, out of 485,973,000 of the settlement amount of KRW 6,325 of the patients who received the procedure using the coos issued by the said hospital as indicated in the attached list of crimes.

Accordingly, Defendant A caused the act of introducing, arranging, and inducing patients to a hospital for profit.

2. Defendant B (2017 high-level 2128) is a doctor to operate H Council members located in Gangnam-gu Seoul Metropolitan Government G.

Any person shall induce any act of introducing, arranging or inducing patients to medical institutions or medical persons for profit, such as exempting or discounting personal contributions under the National Health Insurance Act or the Medical Care Benefits Act, providing money, goods, etc. or providing transportation convenience to many and unspecified persons.
