A defendant shall be punished by imprisonment for six months.
However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
The Defendant is the captain of a petroleum product transport vessel D (126 tons) affiliated with the Marine Oil Transport Business Co., Ltd., and was engaged in the business of transporting sea-free fuel to a specific ocean-going line in accordance with the terms of the vessel fuel transport and oil supply charter agreement concluded between the Defendant and the U.N. P. S. P. P. C., the Defendant is the captain of the petroleum products transport vessel D (126 tons).
A. On February 11, 2016, the Defendant: (a) loaded and transported miters (M380) 260,000 liters owned by SPS (M380) to E in the PS oil storage place located in Pyeongtaek-si PSS oil; (b) while carrying and transporting the miters owned by SPS 260,000 liters for the victim company for the victim company; (c) from around 13:00 of the same day to around 16:25 of the same day, the Defendant supplied the above E vessel at the 707 SPS vessel at the ebbbbbbbb in Yeonsu-gu Incheon, Incheon; and (d) supplied the 2050,000 liters of the Seo-gu, Incheon; and (e) supplied the 5050,000 liters of the vessel’s oil transport on the part of the vessel; and (e) supplied the 13:5050,000 liters of the Seo-gu.
In addition, from that time until March 13, 2017, the Defendant embezzled 225,000 liter’s duty-free oil equivalent to KRW 87,559,050, total amount of duty-free oil, which was owned by the victim company while on duty, as shown in the list of crimes in attached Form 17 times.
(b) A person who intends to engage in petroleum sales business in violation of petroleum and alternative fuel business shall register with the Special Metropolitan City Mayor, Metropolitan City Mayors, Do Governors, etc.;
Nevertheless, on February 11, 2016, the Defendant: (a) around 19:55 on February 11, 2016, at the port wharf of the Seo-gu Incheon, Seo-gu, Seo-gu, Incheon, for 80,000 liters that were embezzled, such as Paragraph (a).
