A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

피고인은 2013. 6. 27. 09:36경 혈중알콜농도 0.082%의 술에 취한 상태에서 업무로 C 아반떼 승용차를 운전하여 서울 노원구 공릉동 소재 좋은치과 앞 편도 4차로 도로를 태릉입구역 방면에서 공릉역 방면으로 위 도로 2차로를 따라 직진 진행하던 중 졸음운전으로 위 도로에 설치된 중앙선을 침범한 과실로 마침 반대 방향에서 진행 중이던 피해자 D(36세) 운전의 E 리오 승용차의 좌측 앞부분을 피고인 승용차의 좌측 앞부분으로 충격하고, 계속하여 인도에 설치된 가로등 전주대를 충격한 후 튕겨져 나와 마침 반대 방향에서 진행하던 F 운전의 G 포터 화물차의 앞부분을 피고인 승용차의 우측 뒷부분으로 들이받아 피고인 승용차에 동승 중이던 피해자 H(30세)으로 하여금 2013. 6. 27. 13:54경 서울 노원구 I 소재 J병원 응급실에서 저혈성쇼크 등으로 사망에 이르게 함과 동시에 다른 동승자인 피해자 K(21세)으로 하여금 약 12주의 치료가 필요한 외상성 두개내 출혈 등 상해를, 피해자 D으로 하여금 약 2주간의 치료가 필요한 경추의 염좌 및 긴장 등 상해를 각 입게 하였다.
